Westchester County NY Passes Paid Sick Leave Mandate

The Westchester County NY Board of Legislators approved a proposed ordinance that will require employers to provide 1 hour of paid sick leave per every 30 hours worked by January 10, 2019 up to 40 hours per year.

Earlier this month, the Westchester County NY Board of Legislators approved a proposed ordinance that will require employers to provide 1 hour of paid sick leave per every 30 hours worked by January 10, 2019 up to 40 hours per year. Unless vetoed by the County Executive today, the ordinance would become effective by April 10, 2019. Unlike other localities, the ordinance includes a provision that would make it ineffective once a federal or statewide law goes into effect with the same or substantially similar provisions.

Impact on Employers and Employees

Mandating that employers provide paid sick leave increases administrative burden, jeopardizes existing leave benefits and limits employers’ flexibility to design leave benefits packages for their unique workforces.
For many employers with generous leave, the main issues are compliance with a myriad of rules in different locales and with the process that deems more generous policies exempt.

Outlook

The County Executive is expected to sign the ordinance today, thus starting the 180-day effective date. Other states and localities are likely to pass paid sick leave mandates if there is no federal or statewide preemption.
