Business Group Supports Bipartisan Telehealth Excepted Benefits Legislation

Business Group on Health and other stakeholders sent letter to Congress supporting bipartisan legislation expanding access to telehealth beyond the COVID-19 public health emergency (PHE).

Business Group on Health, in conjunction with other health care provide employer plan sponsor stakeholders, sent a letter to Congress expressing support for bipartisan legislation, the Telehealth Benefit Expansion for Workers Act of 2023 (H.R. 824), that would expand telehealth access beyond the end of the COVID-19 public health emergency (PHE). The legislation would amend the Public Health Service (PHS) Act, the Employee Retirement Income and Security Act of 1974 (ERISA), and the Internal Revenue Code of 1986 (IRC) to treat telehealth services as excepted benefits. The Business Group and other signatories emphasized the urgent need for this legislation with the temporary non-enforcement position of the Departments of Labor, Health and Human Services, and Treasury to treating telehealth as an excepted benefits scheduled to end with the close of the PHE on May 11, 2023.
