Business Group on Health Comments Regarding NPRM on ACA Reporting and 6055 TIN Solicitations

Business Group responds to the IRS proposal to provide a permanent 30-day extension for ACA reporting and renewed their 2016 request for comments on TIN/SSN solicitations under Section 6055.

The IRS has provided a 30-day extension for providing the ACA 1095-B/C forms since 2015. Their recent notice of proposed rule making (NPRM) seeks to make that extension permanent and provide alternatives reporting mechanisms. Business Group on Health has long been supportive of this flexibility.

Additionally, the NPRM renews a request for comments on earlier proposed rules regarding taxpayer identification number (TIN/SSN) solicitation requirements in order for coverage providers to avoid penalties. Business Group provided comments in 2016 and submitted additional comments in this letter aimed at significantly simplifying the TIN/SSN solicitation requirements for employer plan sponsors.
