Business Group on Health, in conjunction with a broad working group of employer plan sponsor, insurer, and environmental advocate stakeholders, among others, sent a letter to the Department of Labor/Employee Benefits Security Administration (DOL/EBSA) advocating for the Department to issue rules establishing default electronic delivery (e-delivery) of required health and welfare plan documents, disclosures, and notices. The coalition met with the Department on January 5, 2023, where we encouraged the adoption of e-delivery rules for health and welfare plans similar to those adopted for pension plans in 2020. The coalition’s letter responds to questions posed by the Department during the January 2023 meeting and addresses the following:
- How e-delivery ensures consumer protection around information access and security;
- The benefits to consumers’ health and experience with health plan disclosures; and
- Encouraging DOL/EBSA follow their same approach used for the pension plan rule, expanding e-delivery for all health and welfare disclosures as opposed to only a sub-set.
The Business Group and other signatories requested a follow-up meeting with DOL/EBSA to continue discussing the issue, and we continue to advocate for this guidance that will benefit employer plan sponsors, employees and beneficiaries, and the environment.
