On February 6, 2025, Business Group on Health submitted a letter to Congressional leaders urging a balanced approach to pharmacy benefit manager (PBM) reform as lawmakers consider measures for the upcoming March spending package. In our letter, the Business Group emphasizes the importance of increasing transparency and accountability in PBM arrangements while preserving plan sponsors' flexibility to design and manage benefits. The letter highlights concerns about related provisions that have recently been considered, such as mandated fiduciary requirements for vendors, additional civil monetary penalties under ERISA, and broad bans on spread pricing – provisions that could increase administrative complexity and limit plan sponsors’ ability to control costs effectively.
