Business Group Letter to DOL/HHS/Treasury re Transparency in Coverage Rule Temporary Relief

The Business Group has requested a short, reasonable delay of the Transparency in Coverage regulatory requirements for employer plans otherwise due January 1, 2022.

The Transparency in Coverage final rules jointly issued by the tri-agencies in November 2020 have certain initial requirements due by January 1, 2022. Employer plan sponsors are actively working with their vendors to ensure compliance. As part of a broader coalition, the Business Group requested that the Departments provide safe harbor and/or good faith compliance standards for employers to use in complying with the rules. Here, the Business Group has requested additional time for employers to comply and/or to be able to make any changes needed to utilize any safe harbor or good faith standard, if any, issued in the near future.
